Terms and Conditions for Vehicle Owners and Managers

Catch Mobile App is committed to facilitating seamless connections between tourism vehicle owners or managers and travelers (Users) within Sri Lanka's vibrant tourism industry. Our policies ensure transparency, fairness, and accountability in utilizing the Catch App Platform for transportation services. These Terms and Conditions apply to your use of our services through both the Catch Mobile App and our Web App (www.catchapp.lk), including any subscriptions you make through our Platform. By using our services, you agree to follow these terms. Take a moment to carefully read through them before proceeding with any actions or transactions.

Interpretation and Definitions

The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • Account means a unique account created for You to access our Service or parts of our Service through Our Mobile App and Web App.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Green Stream Systems & Solutions (PVT) Ltd, No: 252/1, Pitipana North, Homagama, Sri Lanka.
  • Catch App or Platform means Catch mobile app and its associated Website (www.catchapp.lk) and other services.
  • Service means all the services and facilities available through the Catch App Platform.
  • Users means anyone who uses the Platform.
  • Owners or Managers means individuals, organizations or companies responsible for registering and managing vehicles on the Catch App platform.
  • Vehicle means Buses, Vans, or Cars dedicated for tourism in Sri Lanka.
  • Administrator means a person or a role responsible for managing, configuring, and maintaining the platform.
  • Listing Suspension means the administrative action by Catch App to remove a vehicle from search results due to policy violations or activities detrimental to the Catch community.
  • Subscription Fees means the charges levied for vehicle listing on the Catch platform.
  • Subscription Renewal means the process of extending the subscription period for listed vehicles.

Acceptance of Policies

Owners or managers must thoroughly read and agree to the Refund Policy, Privacy Policy, and Terms and Conditions in the platform before registering.

Use of the Platform

    • You must be at least 14 years old to use our platform or make subscriptions.
    • You are responsible for maintaining the confidentiality of your account information, including your username and password.
    • No form of brokering is permitted.
    • You agree to provide accurate and current information during the registration and checkout process.
    • The registration of Vehicles can only be completed by the Catch App administrators following a physical inspection of the Vehicle details.
    • You may not use our platform for any unlawful or unauthorized purposes.

Subscription Information and Fees

    • Catch App offers three distinct subscription options: Monthly, Quarterly, and Annually.
    • The monthly subscription fee is initially set at 5000 LKR, the quarterly subscription fee is initially set at 4000 LKR per month, and the annual subscription fee is initially set at 3000 LKR per month for all categories of vehicles registered within the platform.
    • The company holds the right to decide the end date of the trial period. Normally it is set to 1st of June 2024 for all the vehicles registered within the system.
    • The Catch App may modify subscription fees due to inflation, the introduction of additional services within the app, operational costs, or changes in taxes.
    • Prices are subject to change without notice. Any promotions or discounts are valid for a limited time and may be subject to additional terms and conditions.

Subscriptions and Payments

    • When you place an order on our Catch App/Catch Web App for our subscription-based service, you're expressing interest in subscribing to the service.
    • We reserve the right to refuse or cancel any order/subscription for any reason, such as availability of service, pricing or historical issues, or suspected fraudulent actions.
    • You agree to provide valid and up-to-date payment information and authorize us to charge the total order/subscription amount, including applicable taxes and other fees, to your chosen payment method.
    • We use trusted third-party payment processors to handle your payment information securely. We do not store or have access to your full payment details.

Subscription Renewal

    • The owners or managers of the vehicles must renew the subscription before they expire by paying the mentioned amount through the Catch App.
    • If an owner or manager fails to renew the subscription for a specific vehicle within two days of its expiry, the vehicle will be automatically inactive in the Platform and will not appear in search results.

Service availability

    • We will make our maximum efforts to ensure the availability of service 24×7.
    • Even though we use cutting edge technologies and modern cloud Platforms to prevent interruptions, sometimes things like network problems in your area or other similar issues might cause a temporary pause in the service.

Listing/Service Suspension

  • Catch App administrators retain the right to suspend vehicles listed in search results without prior notification to the vehicle owner or manager.
  • This action is taken:
    • If any policy violation is detected or if any activity is identified as detrimental to the Catch App community.
    • If a vehicle fails to renew its subscription within two days of expiry, it will be automatically inactive in the system and will not appear in search results.

Reinstatement After Suspension

    • In the event of a suspension resulting from a policy violation, the administrators of the Catch app must await the completion of a thorough investigation conducted by the directors of Green Stream Systems & Solutions (PVT) Ltd or by the legal or judiciary system in Sri Lanka before taking any action.
    • In instances of suspension resulting from payment issues, owners must settle the subscription fees to relist their vehicle in the system.

Subscription Refunds

    • In the event of a vehicle being suspended from search results (Listing) due to any of the terms and condition (Policy) violations, any remaining subscription fee will not be refunded.
    • Our Refund Policy governs the process and conditions for refunds and seeking refunds. Please refer to the Refund Policy provided on our Catch App/Catch Web App for more information.

Maintaining Up-to-Date Information

  • Responsibility for Information Updates: Vehicle owners and managers are accountable for promptly updating any changed information after registering with the platform.
  • Daily Vehicle Schedule Updates: It is the responsibility of vehicle owners and managers to update vehicle schedules daily.
  • Violation Consequences: Failure to update any information, including vehicle schedules, is considered as a violation of the Terms and Conditions and Catch App administrators have the right to suspend the vehicle from the system.

Intellectual Property

    • All content and materials on our platform, including but not limited to text, images, logos, and graphics, are protected by intellectual property rights and are the property of Catch App or its licensors.
    • You may not use, reproduce, distribute, or modify any content from our Platform without our prior written consent.

Limitation of Liability

    • Catch App serves as a platform enabling public access. Users of the app may contact vehicle owners or managers for reservations. However, Catch App holds no responsibility for incidents occurring between users, owners, and managers of the vehicles. It is solely the parties' responsibility to discuss their requirements and reach agreements. If any misconduct is reported during communication between users and owners, Catch App administration reserves the right to permanently suspend the account.
    • In no event shall Catch App Platform or Company, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our platform or the purchase and use of our services.

Amendments and Termination

We reserve the right to modify, update, or terminate these Terms and Conditions at any time without prior notice. Any changes will be posted on this page with a revised "last updated" date. It is your responsibility to review these terms periodically for any changes.
